General
These are the terms and conditions of sale of all products supplied by Cakes Online Australia.
Cakes Online Australia (COA) is a registered business in New South Wales Australia.
Account Customers
Regular customers may establish an account with COA. These customers will be provided with secure access to this website to place their orders.
By Placing an order online, the customer authorises COA to charge all monies payable to COA under these terms and conditions to your credit card. (Please fill in attached authorised form).
Alcohol
When purchasing alcohol or a gift with alcohol you must be over 18 years of age. Proof of age will be required.
NSW Liquor Act 1982: It is an offence to sell or supply to or obtain liquor on behalf of a person under the age of 18 (penalty applies).
Alcohol must not be supplied to or consumed by minors.

All materials and content on this website is owned by COA. No reuse of this material is permitted without prior written consent. COA retains the copyright for the materials contained on the COA website.
Currency
All prices are listed in Australian Dollars (AUD).
Fraudulent Activity
Any orders placed under a false name, with a fraudulently obtained credit card or without the consent of the cardholder are unauthorised, and COA will take such action as it considers appropriate in the circumstances (including reporting such activity to relevant law enforcement agencies and government bodies).
Any party engaged in illegal activities involving the use of this website maybe subject to civil proceeding and criminal prosecution. COA does not guarantee that it will be able to prevent any illegal or inappropriate use of this website, nor that it will give notice of any illegal or inappropriate use of this website.

Pricing
COA reserves the right to modify the pricing and these terms and conditions without notice.
Quality
The majority of our commercial suppliers are HACCP certified.
Office Hours
Our office hours are Monday to Friday between 8:30am and 4:30pm. Excluding Public Holidays and other notified periods.
Privacy Policy
COA will only use the information provided to it by its clients for its own internal use. COA will manage and protect your information in accordance with the relevant and appropriate privacy legislation in Australia.
Warnings
You should be aware that products supplied by Cakes Online Australia may include candles, flowers, customised plaques or other items intended to be affixed or attached to particular products. Such items should be handled by suitably aged persons, and not provided to children. All such items should be removed from the product prior to consumption. Special care should be taken with any lit candles.
Allergens
Our products may contain food allergens. These include nuts, sesame seeds and their products, cereals containing gluten and their products, food additives or components of food additives, egg and egg products, milk and milk products, peanuts and soy beans and their products, ingredients containing added sulphites, GM modified ingredients and irradiated ingredients.
Please advise us of any special requirements.
Shelf Life
COA advises that the cakes and other similar products have a shelf life of 3 days. The storage of these products may require refrigeration to achieve this shelf life. Please refer to the individual product descriptions for specific information.
Orders
Orders must be placed prior to 2pm Monday to Friday (excluding Public Holidays). There are 3 methods to place an order:
- phone, 1300 78 35 06
- fax, 1300 78 35 07, please use this printable order form
- online are received 24/7 (and will be ordered prior to the 2pm cutoff each day or for the specified date)
Orders of $35 or less will incur a delivery charge of $15. In other cases our standard delivery policy applies.
Cupcakes, Lamingtons and special orders require 5-7 business days notice.
COA reserves the right to modify the items for sale from time to time and make changes without notice.
Custom Orders
Special orders can be accepted but may take more time to organise and deliver. Separate pricing will be provided.
Late Orders
Orders placed after 2pm Monday to Friday cannot be fulfilled for next day delivery.
Delivery
Cakes and other perishable items are delivered only within the Sydney Metro area.
Delivery will be between 8am and 12pm each day. Specific delivery times can be requested and a delivery fee will be charged.
Delivery to residential addresses will incur a delivery fee.
Delivery outside of the Sydney CBD, Lower North Shore Business Area and the Norwest Business Precinct will incur a delivery fee.
If delivery is attempted at the specified address and it's not possible to complete the delivery e.g. no one there to receive it, the building is locked. The contact number will be phoned. An additional redelivery fee will be charged.
Hampers and vouchers are delivered Australia wide.
* Any hampers displayed may also be available in a smaller or larger size to the one shown. If a product is sold out, it will be substituted with something of the same or greater value.
* Each hamper contains a personalised gift card.
* We recommend substituting perishable products if the order is to be shipped interstate.
* If purchasing a gift with alcohol you must be over 18 years of age.
COA shall not be liable for any failure or delay in supply or delivery of any product where such failure or delay is wholly or partly due to any cause or circumstances whatsoever outside the reasonable control of COA including but not limited to war, strikes, lockouts, industrial disputes or unrest, government restrictions or intervention, transport delays, fire act of God, breakdown of plant, shortage of supplies or labour, storm or tempest, theft, vandalism, riots, civil commotions, act of terrorism or accidents of any kind.
Delivery Charges
COA reserves the right to charge a delivery fee if online orders, delivery fee selection, are found to be incorrectly completed.
Returns and Cancellations
Cancellations:
It is possible to cancel an order prior to 2pm on the day of submitting the order or 2 days before the due delivery date, or as otherwise specified. A cancellation will attract a $15 cancellation fee.
If the cancellation is made after this time the full charge for the ordered items will be made to the full value of the order.
Returns:
If the goods delieverd by COA for your order are damaged in transit, please contact COA immediately. Do not consume the items. If they are consumed it is assumed they are of suitable quality.
COA will collect the items and provide a credit note for the value of the returned items.
